Steps Followed During Civil Litigation

  • Demand letter – The plaintiff’s attorney will send written notice to the defendant informing them of the intent to take legal action and asking the defendant to take certain actions within a specific time period. For instance, a demand letter may state that the defendant owes a certain amount of money to the plaintiff, and if this amount is not paid by a certain date, a lawsuit will be filed.
  • Pleadings – Each party will have the opportunity to file legal documents with the appropriate court explaining their side of the case. The plaintiff will file a complaint that states how they were harmed by the defendant and the remedies they are seeking. This complaint will be served to the defendant, who will then file a response that addresses the plaintiff’s allegations.
  • Discovery – Both parties will seek to obtain information that can be used as evidence during a trial. In addition to performing any necessary research, each party’s attorney can obtain information from the other party through interrogatories or requests to produce documents or admit facts. They may also conduct depositions or use subpoenas to gather evidence from any relevant sources.
  • Pre-trial – Prior to a trial, the parties may attempt to negotiate a resolution to their dispute. If they can reach a mutually agreeable settlement, the case can be resolved without the need for a trial.
  • Trial – If a settlement cannot be reached, a trial will be held in which both parties will present their side of the case to a judge or jury. At the completion of the trial, the judge or jury will decide in favor of the plaintiff or the defendant, and this decision may specify an amount that one party will pay to the other or require either party to take certain actions.
